Course Description
Recent changes in the law have drastically expanded an attorney's obligations under HIPAA. Those who represent healthcare providers and related organizations are generally considered "Business Associates," and therefore are subject to direct civil and criminal liability under HIPAA. As such, these attorneys must fully understand all of their duties regarding "Protected Health Information" (PHI), such as how it can be used, when it can be disclosed, and what measures must be taken to protect it from 3rd parties. In this program, healthcare attorney Carol Scott will guide you through this ethical morass, covering topics such as drafting a Business Associate Agreement, proper and improper use of PHI, conducting risk assessments, pertinent state laws, and more.
