Course Description

In this 1-hour Ethics program, three trial lawyers discuss key ethical issues that all litigators should be familiar with. Topics covered include:

E-Discovery: Trial lawyer Nikki Nesbitt discusses attorneys' responsibilities to ensure client compliance with litigation holds, and sanctions that can be issued against counsel for e-discovery violations.

Online Investigations of Parties, Witnesses, and Jurors: Trial lawyer Jerry Glass discusses ethical considerations when investigating opposing parties and witnesses, as well as jurors during and after jury selection.

Settlement Negotiations: In settlement negotiations, the line between puffery and misrepresentation can be thin. It's easy to violate ethical proscriptions when communicating with opposing parties, opposing counsel, and mediator, and your own client. Trial lawyer Carolyn Fairless provides some easy-to-follow guidelines and interesting practical examples.
