Course Description
With this course, attorneys involved in immigration defense cases will gain an understanding of the mental health and evaluation issues for immigration clients who may require competency evaluations. These clients may already be in proceedings or may be held in an ICE detention center pending an outcome of the evaluation. Join attorney and forensic expert Mark Silver for an in-depth analysis of Matter of M-A-M Cases.Learning Objectives: I. Understand the major concerns in a competency hearing based on the Matter of M-A-M Case II. Identify the major challenges and evaluation issues for such clients III. Recognize the major psychiatric diagnoses and concerns with respect to such clients for these competency hearings IV. Comprehend the major concerns encountering prosecutors claims of the client “Malingering,” that is, faking a psychiatric diagnosis

Meet the Lecturer(s)
MARK S. SILVER is a lawyer and New York State Licensed Clinical Social Worker, with a doctorate in psychology and a post-graduate certificate in family therapy. He is the author of several publications. Since 2002, Mark has worked as a consultant for law firms throughout the United States conducting psychosocial evaluations and writing formal reports in forensic and mitigation immigration and criminal cases. He has worked with thousands of clients from over forty countries on various individual, family, and mental health issues related to criminal conduct and deportation. He has also provided expert testimony in many of these cases in Immigration Court and lectures to lawyers throughout the United States on a wide range of forensic issues with case samples.
