Course Description

Recent changes in the law have drastically expanded an attorney's obligations under HIPAA. Those who represent healthcare providers and related organizations are generally considered "Business Associates," and therefore are subject to direct civil and criminal liability under HIPAA. As such, these attorneys must fully understand all of their duties regarding "Protected Health Information" (PHI), such as how it can be used, when it can be disclosed, and what measures must be taken to protect it from 3rd parties.
In this program, healthcare attorney Carol Scott will guide you through this ethical morass, covering topics such as drafting a Business Associate Agreement, proper and improper use of PHI, conducting risk assessments, pertinent state laws, and more.

Carol Scott

Carol Scott is a partner at Hinshaw & Culbertson. Her practice focuses on health care law and labor and employment law. In her health care practice, she advises clients on a wide range of business, regulatory, corporate and compliance issues. Her clients include for profit and nonprofit providers, physicians, medical groups, hospitals, and more. She regularly advises health care providers and facilities on the design and implementation of compliance plans regarding HIPAA, billing and reimbursement, compliance with fraud and abuse and anti-kickback laws and all aspects of their operations and has conducted compliance and HIPAA training for such entities. Ms. Scott's labor and employment practice includes non-health care as well as healthcare clients, and includes review and drafting of handbooks, policies and procedures; employment training; drafting and negotiation of contracts; conducting investigations and advising on wrongful termination, disability, discrimination and harassment claims; and related matters.
